You are only authorized to use the site and its services if you agree to abide by these Terms and Conditions, as well as all applicable laws. If you do not accept these Terms and Conditions, then you must discontinue your use of the site and services affiliated with the site immediately. TheDailyCollective reserves the right to change these Terms and Conditions at any time, and for any reason, with or without notification. We recommend that you periodically check this page for changes.
Prohibited Uses
Without limiting any other provisions of this agreement, you may not use the website or service provided by TheDailyCollective for any purpose that is unlawful or prohibited by this agreement and/or any applicable additional terms. Your access to TheDailyCollective website and it's service may be terminated immediately in our sole discretion, with or without notice, if you fail to comply with any provision of this agreement and/or additional terms, including the site's rules, the Collective Code, or for any other reason, or no reason.
By using TheDailyCollective site and/or its service you expressly agree not to:
1) Act as an agent, affiliate or representative of TheDailyCollective site and/or utilize this site or its contents for any commercial purpose other than for which TheDailyCollective site is intended without express written permission from TheDailyCollective,
2) harass, threaten, or cause distress, unwanted attention or discomfort upon any other person affiliated with this site or using this site or service, including any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful material, including but not limited to material based on a person's race, national origin, ethnicity, religion, gender, sexual orientation, disablement or other such affiliation,

5) violate any operating rule, regulation, procedure, policy or guideline of TheDailyCollective as published on the TheDailyCollective site, including, but not limited to, the Collective Code, Terms and Conditions and Privacy Policy,
7) infringe upon the intellectual property rights or other rights of TheDailyCollective site, its service, or third parties, including trademark, copyright, trade secret, patent, publicity right, or privacy right,
8) distribute software or other content in violation of these terms, TheDailyCollective Privacy Policy, any law, or any other established agreement.
No Warranty and Limitation of Liability
TheDailyCollective and Contract Creativity, LLC provides the site and services "as is" and without any warranty or condition, express, implied or statutory. TheDailyCollective and Contract Creativity, LLC disclaims any implied warranties or merchantability, fitness for a particular use, information accuracy, integration, or quiet enjoyment. Some states do not allow the disclaimer of implied warranties, under this particular exception, the above exclusion may not apply to you.
You understand and agree that you use TheDailyCollective site and service at your own discretion and risk and that you will be solely responsible for any damages that arise from its use.
Under no circumstances shall TheDailyCollective be liable for any direct, indirect, special, incidental, consequential or punitive damages of any kind, or any other damages whatsoever, however they may arise, including negligence, including without limitation, damages related to use, misuse, reliance on, inability to use and interruption, suspension, or termination of this site or its services, regardless of any circumstances. Furthermore, TheDailyCollective and Contract Creativity, LLC, will not, under any circumstances, be held liable for damages incurred through any links provided on this site and damages resulting from loss of use, sales, data, goodwill or profits, whether or not TheDailyCollective and Contract Creativity, LLC has been advised of such a possibility.
By accessing TheDailyCollective site and using its service, your only right with respect to any dissatisfaction with the site or with TheDailyCollective shall be to terminate use of the site and its services. Other
TheDailyCollective and Contract Creativity, LLC, in their sole discretion, may terminate your membership without notice if TheDailyCollective believes that you have violated or acted inconsistently with the Terms and Conditions, Privacy Policy or have violated the Collective Code in any way.
TheDailyCollective and Contract Creativity, LLC will not be liable to you for termination of your membership to or use of the service for any reason.
TheDailyCollective and Contract Creativity, LLC reserve the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that TheDailyCollective and Contract Creativity, LLC shall not be liable to you or to any third party for any modification, suspension or discontinuance of the service.
TheDailyCollective's Terms and Conditions as noted above may be updated from time to time without notice to you. In addition, when using TheDailyCollective site or its services, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted at any time.
Provisions Unenforceable or Invalid
If any part of this agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as closely as possible, the original intentions of the parties, and all remaining portions will remain in full effect.
